Privacy Policy

This Privacy Policy sets out the basis on which any personal data we collect from you, or that you provide to us, will be processed by us. This is whether you are a visitor to the business, a customer, employee or a corporate customer’s director who provides personal information to us during the course of our relationship. This policy has been written to comply with the General Data Protection Regulations (GDPR) which come into force on 25th May 2018.

 

Who are Sinclair Finance & Leasing Co Ltd?

Sinclair Finance & Leasing is registered under company number 02063682 and its registered office is c/o Sinclair Group, Bocam Park, Old Fields Road, Bridgend, CF35 5LJ.

Any use of the terms us, our,we or SFL in this policy statement refers to Sinclair Finance & Leasing Co Ltd.

SFL offers finance facilities to private individuals, sole traders, partnerships, Limited Companies and Public Sector Bodies to acquire vehicles and certain capital equipment. We trade as ‘Sinclair Direct’ for the sale of used vehicles, service and maintenance of vehicles and certain ancillary motor-based insurances and dealer guarantees.

We are registered with the Financial Conduct Authority, registration number 305907

Our trading address for Sinclair Finance and Leasing and Sinclair Direct is Hernston Business Park, Bridgend, CF31 3NB.

 

What information do we collect?

If applying for finance we need all the information one would expect to supply in a credit application such as name, address, house occupation status, date of birth, and other information required to provide acceptance. In the case of a Limited Company, names and home addresses of all Directors may be required. You will also be required to provide bank information so that payments can be made.

If you are an employee of a Limited Company or driver of a leased vehicles then we will require contact details such as a telephone number and an e-mail address. We will require the personal addresses and contact details from all car purchasers and users of our service and maintenance department.

 

Why we require the Information you give us: 

  • To carry out our obligations arising from any agreements entered into between you and us and to provide you with the information, products and services that you request from us
  • To notify you about changes to any of our services
  • To provide reminders for your vehicles such as MOT’s, service’s etc.
  • To discuss and explain queries that may arise regarding payment
  • To provide you with information about other goods and services we offer that are similar to those that you have already purchased or enquired about, as further detailed in the ‘Marketing’ section below
  • To pass on relevant information to the police under a legal obligation, should your vehicle be involved in a traffic offense, accident or other incident.

Who we share your information with? 

The information we record about you will be accessible to all SFL employees.  We may need to share your basic contact details with a third-party supplier such as our tyre suppliers or franchised motor dealer who is servicing or repairing your vehicle.

Your personal information will become the basis of a legal contract should you apply for any of our Finance & Leasing products and will be passed on to recognized credit searching companies which will assist in our decision to grant or decline credit.

Your contact details may be passed on to the police, local authority or other official body under our legal obligation in the case of a traffic offence, accident or breach of the law.

With your consent your contact details may be sent to a consumer survey company who assists us in the measurement of our service to you and improvement of future performance.

Your personal data may be shared with financial services organisations, such as companies who provide hire-purchase funding and banks providing such funding. This is for the purpose of securing such funding on your behalf. We may provide personal data to enable these financial services organisations to carry out necessary searches in order to enable them to make a funding decision for you and meeting their legal and regulatory requirements.

SFL will not pass personal information to any other company for the purpose of marketing, whether it be by telephone, post, SMS or email. If you have any concerns about what information we have passed on to a third party then please feel free to enquiry this with us.

To summarise appropriate data will be shared for processing only with those who have a legitimate and contracted business reason. Additionally only those who have access to your personal details and your vehicles information will only normally have access to that which they need to fulfill their roles.

 

How we keep your information safe and secure

Online privacy and security is the most important aspect of any customer service and we take it extremely seriously. We use a variety of the latest technologies and procedures to protect your personal information from unauthorized access, destruction, use or disclosure.  All data is stored in a specialist management software and only SFL employees and the software and IT contractors have access to this.

 

Your rights to the data we hold about you

How long do we keep your information for?

We will keep your personal information for as long as we need it to provide the services you have signed up for. We may also keep it to comply with our legal obligations, resolve any disputes and enforce our rights. These reasons can vary from one piece of information to the next and depend upon the products or services you are signed up to; thus the amount of time that we keep your personal information for, may vary but as an indication –

  • Contact details and proofs of address given for the purpose of requesting marketing information and taking test drives in vehicles will be retained for six months.
  • All personal information relating to a legal Finance or Leasing agreement or the purchase or service of a vehicle will be retained for seven years after the completion of the contract in line with our legal obligations.

In all cases, our need to use your personal information will be reassessed on a regular basis, and information that is no longer required for any purposes will be disposed of via an appropriate method.

 

Your rights

You have certain rights in relation to your personal information that is processed by us. These rights are listed below. These rights are not absolute and apply subject to certain conditions, as set out in applicable data protection laws. Your rights may include:

  • The right to access personal data held by us about you
  • The right to require us to rectify any inaccurate personal data held by us about you
  • In certain circumstances, the right to require us to erase personal data held by us about you;
  • In certain circumstances, the right to restrict our processing of personal data held by us about you
  • In certain circumstances, a right to receive personal data that you have provided to us in a structured, commonly used and machine-readable format. You may also have the right to require us to transfer this personal data to another organization, at your request
  • The right to object to our processing of personal data held by us about you (including for the purposes of sending marketing materials to you)
  • The right to withdraw your consent, where we are relying upon it to use your personal data (for example, to provide you with marketing information about our services and products)
